Skilled – Sponsored (Migrant) visa (subclass 176)

This is also a permanent residency visa. This visa is suitable for people who cannot pass the points test to be eligible for the grant of the Subclass 175 visa discussed above. The difference between the Subclass 175 visa and this visa is that for this visa, you or your spouse are required to have an eligible relative in Australia who is willing and able to sponsor you or you must be nominated by a State or Territory in Australia. In order to be eligible for the grant of this visa, you must:

  • be under 45 years of age;
  • have good English language skills;
  • be able to nominate an occupation from the Australian Skilled Occupation List (SOL);
  • obtain a positive skills assessment for the nominated occupation;
  • pass the points test (100 points only);
  • either meet the work experience requirement or the 2 year study requirment; and
  • have sponsorship from either an eligible relative in Australia or a nomination from a State or Territory in Australia offering nominations for this type of visa.

In order for the grant of this visa to be effective you may be in Australia or outside Australia at the time of application but must be outside of Australia when this visa is granted. Eligible New Zealand Citizens (who hold a Subclass 444 visa) may be in Australia or outside Australia when this visa is granted.

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

This is a temporary visa for 3 years designed for people who cannot meet the criteria for the grant of a Subclass 175 visa. In order to be eligible for the grant of this visa, you must:

  • be under 45 years of age;
  • have good English language skills;
  • be able to nominate any occupation (60 or 50 or 40 point occupation) from the Australian Skilled Occupation List (SOL);
  • obtain a positive skills assessment for the nominated occupation;
  • pass the points test (100 points only);
  • either meet the work experience requirement or the 2 year study requirment; and
  • have sponsorship from either an eligible relative in Australia or a nomination from a State or Territory in Australia offering nominations for this type of visa.

In order for the grant of this visa to be effective you may be in Australia or outside Australia at the time of application but must be outside of Australia when this visa is granted. Eligible New Zealand Citizens (who hold a Subclass 444 visa) may be in Australia or outside Australia when this visa is granted.

Following the grant of this visa, you can remain in Australia (in a “Specified Region” in Australia) for three years in order to take steps to satisfy the criteria needed for the grant of an Australian permanent visa. You will have the opportunity to apply for a permanent visa and may be granted a permanent visa either after two years or when this visa expires provided that you can show that:

  • you have lived for a minimum of two years in a Specified Regional Area of Australia while holding this visa; and
  • you have worked for at least 12 months full-time in that Regional Area.

What is considered to be a “Specified Regional Area” for the purposes of the permanent visa application will depend on whether you applied for this Temporary Visa on the basis of a sponsorship from an eligible relative or the nomination from a State or Territory in Australia.
