Spouse temporary visa (subclass 820) and permanent visa (subclass 801)

This visa is for people who are married or in a de-facto relationship with either:

  • an Australian citizen;
  • an Australian permanent resident; or
  • an eligible New Zealand citizen.

In order to be eligible to apply for this visa, you must currently be in Australia and must be sponsored by your partner. Once the temporary visa has been granted and you have spent approximately 2 years on the temporary visa in Australia with your partner, a permanent visa may be granted on the basis of your relationship.

Interdependency temporary visa (subclass 826) and permanent visa (subclass 814)

Similar to the Subclass 820, this visa is for people who are in a relationship with:

  • an Australian citizen;
  • an Australian permanent resident; or
  • an eligible New Zealand citizen.

Nevertheless, in order to be eligible to apply for this visa you must generally be in a same-sex relationship.

Aged Parent (Permanent) (Subclass 804)

This visa is for aged* people, who have:

at least half of their children living in Australia; or
have more than a half of their children living in Australia.

In order to be eligible for this visa your child or children in Australia must be:
 
  • Australian citizens;
  • Australian permanent residents; or
  • eligible New Zealand citizens.

They must also provide you with a sponsorship.

Contributory Aged Parent (Migrant) Visa (Subclass 864)

This visa is also a permanent visa and is similar to the Subclass 804 visa. However, the application fee for this visa is higher and the application itself is processed faster than the application under Subclass 804.

Contributory Aged Parent (Temporary) Visa (Subclass 884)

This is only a temporary visa and cannot be extended or renewed. The validity period of this visa is generally 2 years following which you may be able to apply for permanent residency under Subclass 864.

Contributory Parent (Migrant) Visa (from Subclass 884 to Subclass 864)

This visa is for holders of a Subclass 884 visa. Once you have held the Subclass 884 visa you may apply for this visa in order to get permanent residency in Australia.

In order to apply for this visa, you must continue to be sponsored by your child or children in Australia.

Child (Permanent) (Subclass 802)

This is a permanent visa for children of Australian citizens, Australian permanent residents or eligible New Zealand Citizens. The child applying for this visa must be in Australia in order to apply for this visa. The grant of this visa entitles the child to remain in Australia permanently . The child must be under 25 years of age and must be spoonsored by his or her parent. This visa does not only apply to natural children, but also adopted children and step-children whose legal parent is an Australian citizen, Australian permanent resident or eligible New Zealand citizen. One of the requirements of this visa is that the child seeking to remain in Australia is not married.

Orphan Relative (Permanent) (Subclass 837)

This visa is for children who are less than 18 years of age and whose parents are deceased, permanently incapacited or missing, as a result of which they are unable to care for their child. The child can in this instance be sponsored under this Subclass to remain in Australia. The sponsorship, however, must be provided by one of the following groups of relatives:

  • brother;
  • sister;
  • grandchild;
  • niece;
  • nephew; or
  • step equivalent of one of the above.

The sponsor of an orphan relative must be:

  • an Australian Citizen;
  • an Australian permanent resident; or
  • an eligible New Zealand Citizen.

Dependent Child Visa (Subclass 445)

This visa is for children of parents who have a temporary visa in Australia and have not been granted a permanent visa as yet. The parent holding a temporary visa in Australia must have one of the following:

  • temporary Spouse visa (subclasses 309 or 820); or
  • temporary Interdependency visa (subclasses 310 or 826).

In order to be eligible to apply for this visa, the child must be:

  • single;
  • under the age of 18 (or if over the age of 18 financially dependent on the parent); and
  • be sponsored by the same person who is also the sponsor of the parent who holds one of the temporary visas listed above.

Remaining Relative (Subclass 835) (Permanent)

This visa has been designed for people who have a brother, sister, parent (or step-equivalent) who are an Australian citizen, Australian permanent resident or eligible New Zealand citizen usually resident in Australia. In order to be eligible to apply for this visa, you must have sponsorship from the Australian near relative (an Australian citizen, Australian permanent resident or eligible New Zealand citizen). Generally, you may only be considered for this visa if you do not have other near relatives in the countries other than Australia.

Aged Dependent Relative (Subclass 838) (Permanent)

This visa is for aged* people who are relatives of:

  • an Australian Citizen;
  • an Australian permanent resident; or
  • an eligible New Zealand Citizen.

In order to be eligible to apply for this visa, you must be:

  • aged;
  • single; and
  • have a relative in Australia on whom you are financially dependent.

This is a visa allowing you to stay in Australia permanently.

Carer (Subclass 836) (Permanent)

This visa has been designed to accommodate people who need to remain in Australia in order to care for their relative who has a medical condition.

In order to be eligible for this visa, the Australian relative in need of care must be in need of care, which can generally not be provided by another relative in Australia or by hospital, nursing or community services in Australia. The applicant for this visa must be prepared to provide the necessary care and must have a relative in Australia who is either his/ her:

  • spouse;
  • child;
  • parent;
  • brother;
  • sister;
  • grandparent;
  • grandchild;
  • aunt;
  • uncle;
  • niece;
  • nephew; or
  • step-equivalent of one of the above.

The applicant for this visa must be sponsored by either:

  • an Australian Citizen;
  • an Australian permanent resident;
  • an eligible New Zealand Citizen; or
  • the spouse of one of the above.

New Zealand Citizen Family Relationship Visa (Subclass 461) (Temporary)

New Zealand Citizens who are in Australia and who do not hold a permanent visa are automatically granted a special category (Subclass 444) visa. Subclass 461 visa is designed for people who are not New Zealand Citizens and who wish to join the special category (Subclass 444) visa holder in Australia.

The applicants for Subclass 461 must be relateed to the special category visa holder by either being his/ her:
  • spouse
  • dependent child
  • a dependant child of the spouse’s dependnat child; or
  • the spouse’s relative who is:
  • widowed, divorced, separated or never married and usually resident in the special category visa holder's household
  • dependent on the special category visa holder.
